Buyer's Broker of Northern Michigan, LLC was founded by
Stefan J. Scholl, a
practicing real estate attorney, on the principle that home buyers and purchasers of real
estate have a right to equal representation, just like litigants in the
courtroom. Oftentimes, buyers are not aware of the fact that
seller agents do not r epresent
them. Seller agents refer to buyers as "customers" rather than
"clients". Legally, this is an important distinction, and buyers
should be aware that seller agents owe them almost no duties. Although
buyers provide the funds to close a real estate transaction, they often
complete their purchases without the benefit of any representation
whatsoever. Lack of buyer representation puts the buyer at a distinct disadvantage
as compared to the seller, who usually has the benefit of one or more agents
working on his or her behalf and duty bound to look out for their
seller-client's best interests. Buyer's Broker of Northern Michigan, LLC
was created to help level the playing field.
Before disclosing any confidential
information to a real estate licensee regarding a real estate transaction,
you should understand what type of agency relationship you have with that
licensee. Michigan law requires real estate licensees to advise
potential sellers or buyers with whom they work of the nature of their
agency relationship. This is done by means of an agency disclosure
form, which is real estate's functional equivalent to being read your miranda rights. If you are a buyer, and a
real estate agent discloses that he or she is an agent of the seller, you
must be aware of the fact that anything you say can and will be used
against you in the course of negotiations.
A Seller’s Agent (also referred to as a listing
agent), under a listing agreement with the seller, acts solely on behalf
of the seller. A seller can authorize a seller’s agent to work with
subagents and/or buyer’s agents. A subagent is one who has agreed to
work with the listing agent, and who, like the listing agent, acts solely
on behalf of the seller. Seller’s agents and subagents will disclose to
the seller known information about the buyer which may be used to the
benefit of the seller. Seller agents have duties of loyalty, confidentiality
and obedience to their seller clients. By law, seller agents
must represent, advise, negotiate and advocate on behalf of their seller
clients.

Buyer's Agent, under a buyer’s agency agreement with
the buyer, acts solely on behalf of the buyer. Buyer’s agents will disclose to the buyer known information about the seller
which may be used to benefit the buyer. Buyer agents have duties of
loyalty, confidentiality and obedience to their buyer clients. By law, buyer
agents must represent, advise, negotiate and advocate on behalf of their
buyer clients.
Buyer's Broker of Northern Michigan, LLC acts as an exclusive buyer's
agent, representing buyers only. As an exclusive buyer's agent,
there is ne ver any question as to whom we represent in a transaction.
We do not list properties for sale or represent sellers. Other agents
may be willing to act as your buyer's agent. However, if that agent or
his or her office also lists properties for sale and represents sellers, there will undoubtedly
be the potential for conflicts of interests. This may make it more
difficult for you to
purchase the ideal property on the best terms possible.
Lawyers from the same law firm are ethically prohibited from representing
both parties to a transaction. As a buyer, do you really want the real
